Declaration of Bankruptcy before Contravention Hearing

Doolan [2015] FCCA 634 (20 March 2015)

This was a decision regarding applications made by a wife alleging contraventions of orders made by His Honour Small. The husband declared bankruptcy a day before the hearing of the contravention applications. The result was that the debts owed by the husband on the first day of the contravention hearing could not be enforced. The court was not minded to grant leave to allow the wife to continue proceedings against the husband.
